STATE-BY-STATE

There is now federal legislation that protects the rights of integrity and paternity regarding works of visual art, i.e. the right to be credited as the author and to prevent destruction or alteration. Many states have also enacted legislation for the protection of artist's rights, and, in the case of fine print disclosure, for consumer protection. These state laws go beyond the protection provided by the federal VIisual Artists Rights Act (VARA) and, thus, remain in effect.

Pursuant to "fine print disclosure laws," as a penalty for providing false information, the seller of a fine print must refund up to three times the purchase price. Fine prints laws do protect your career as well, because they discourage the production and distribution of unauthorized copies of your work. Also, if you sell directly to the public, you may be subject to these laws and penalties, if you provide false information.

The following is a table of state laws which still apply only to consignment agreements, and fine print disclosure, although you may require the advice of specialized legal counsel in order to fully understand those laws.
